A patent lawyer is a lawyer who specializes in intellectual property law, specifically in patents. They have in-depth expertise in matters of patent law and have passed the United States Patent and Trademark Office patent agent registration examination. Patent lawyers represent inventors in the patent application process and assess whether inventions are new and innovative and, therefore, are entitled to patents. They draft patent applications, provide advice, contradictions, cancellations, cancellation differences, difficulties, and third-party objections. Patent lawyers also deal with infringement on patents and patent applications and enforce the rights of the invention when patents are violated. They may litigate disputes before the Patent Office or regular civil courts, and form strategies for asserting or defending patent rights. Patent lawyers also provide business advice and intellectual property protection, counsel clients on both the strength of their patent and how they can maximize the benefit of their invention, and deal with the management of intellectual property. Patent attorneys are fully qualified and licensed to practice law the same as any other lawyer, but also have the valuable added asset of being admitted to practice (“registered”) before the United States Patent Bar.
