Bail jumping is a criminal offense that occurs when a person who has been released from custody, with or without bail, on the condition that they subsequently appear in court, intentionally or knowingly fails to appear in accordance with the terms of their release. Bail jumping is a violation of a court order, and the defendant forfeits any bail or bond. Bail jumping is usually a Class A misdemeanor, punishable by a fine of up to $4,000 and/or jail time of up to one year. However, if the offense for which the defendant failed to appear is a felony, then bail jumping is charged as a third-degree felony, which is punishable by two to ten years in prison. Bail jumping applies to defendants who make cash bail and those released on their own recognizance. Bail jumping can be a separate charge that can be filed against a defendant, even if they are not tried or convicted of the original charge.
