Deferred adjudication is a form of plea deal available in some jurisdictions, which relates to criminal cases and specifically to the sentencing phase for crimes. With deferred adjudication, there is no conviction, and the court defers or postpones the adjudication of the criminal case pending the completion of community supervision and satisfaction of additional conditions. Deferred adjudication is essentially a type of probation, but unlike straight probation, it does not go on the defendants permanent record after successful completion. The charges against the defendant may be dropped if they successfully fulfill the agreements requirements. However, it is important to note that a deferred adjudication does not remove the criminal charge from ones record. The extent to which the record of a deferral can be discovered or disclosed varies by jurisdiction. The conditions of deferred adjudication vary by state and are at the judges discretion, but commonly include paying court costs and fees, obtaining and/or maintaining a job, performing community service, meeting regularly with a probation officer, submitting to counseling, avoiding the use of drugs/alcohol, obeying state and federal laws, and avoiding new criminal behavior.
