The HITECH Act, or Health Information Technology for Economic and Clinical Health Act, is part of the American Recovery and Reinvestment Act (ARRA) introduced during the Obama administration. It was created to stimulate the adoption of electronic health records (EHR) and the supporting technology in the United States. The HITECH Act incentivized the adoption of EHRs for HIPAA Covered Entities. The Act also established a Health IT Policy Committee to make recommendations related to the implementation of a national health IT infrastructure. The HITECH Act expanded the scope of privacy and security protections available under HIPAA compliance by increasing the potential legal liability for non-compliance and providing for more stringent enforcement. The Act provides financial incentives to eligible professionals for the meaningful use of certified qualified EHRs. The HITECH Act has encouraged providers to use electronic health records and has encouraged offices to take more security measures.
