Quid pro quo harassment is a type of sexual harassment that occurs in the workplace when someone in a position of power, such as a manager or supervisor, seeks sexual favors from an employee in exchange for some type of job benefit or to avoid some type of detriment. The Latin phrase "quid pro quo" means "something for something". Quid pro quo harassment is one of the two types of workplace harassment claims that fall under Title VII of the Civil Rights Act, the other being hostile work environment harassment.

To claim sexual harassment based on quid pro quo, a claimant must be able to prove the following elements:

  • The plaintiff was an employee of or applied for a job with the defendant company.
  • The alleged harasser, an officer or employee of the defendant company, either made unwelcome sexual advances to the plaintiff or engaged in other unwanted verbal or physical conduct of a sexual nature.
  • The plaintiffs submission to the unwelcome advances or conduct was an express or implied condition for receiving job benefits or avoiding job detriments.

Its important to note that existing employees arent the only ones who can claim quid pro quo harassment in the workplace. Job applicants may also bring a claim in certain situations, such as when a hiring supervisor promises an interviewee a job, but only if the interviewee agrees to their sexual advances.
