Unlawful imprisonment, also known as false imprisonment, is an intentional act of restraining another persons movement within any area without legal authority, justification, or the restrained persons permission. It is a crime and a tort under common law. Actual physical restraint is not necessary for false imprisonment to occur. A person commits unlawful imprisonment if they knowingly restrain another person. Unlawful imprisonment is a class C felony. False imprisonment can occur in a room, on the streets, or even in a moving vehicle. Examples of false imprisonment include locking someone in a room without their permission, grabbing onto someone without their consent, detaining someone for an unreasonable amount of time without justification, and detaining an employee for questioning for an unreasonable amount of time for suspected theft. A person who consents to confinement may not later claim false imprisonment.
