Polygamy is illegal in all 50 states, as well as the District of Columbia, Guam, and Puerto Rico. The Edmunds Act outlawed polygamy in federal territories, and there are laws against the practice in all states. In Utah, polygamy is treated as an infraction, which is punishable by a fine up to $750, compensatory service, forfeiture, disqualification, or a combination of those punishments. In other states, polygamy is usually punishable by imprisonment and/or a fine. However, in Utah, a federal judge struck down a portion of the states bigamy laws as unconstitutional in 2013, which allowed consenting adults to live together and criminalized their intimate sexual relationships. The rest of Utahs bigamy law remains intact under the ruling, so only individuals who fraudulently obtain multiple marriage licenses would be guilty. Enforcement of polygamy laws is relatively difficult given the often secretive nature of many polygamists and the fact that most will have only one marriage on paper.
