If a driver passes the three field sobriety tests, they will only be sanctioned or penalized for the traffic offense for which they were pulled over, and not for violation of the Anti-Drunk and Drugged Driving Act. Passing the field sobriety test or the breathalyzer test means that the driver has not failed the test and has not shown any signs of impairment. Therefore, they will not be subjected to penalties under the Anti-Drunk and Drugged Driving Act. However, if the driver fails any of the field sobriety tests, they will be subjected to a breathalyzer test to determine their blood alcohol concentration level. If the driver fails the breathalyzer test, they will be arrested and penalized for violating the Anti-Drunk and Drugged Driving Act.
