The Indian Act is a piece of legislation that has undergone numerous amendments since it was first passed in 1876. The Indian Act made enfranchisement legally compulsory, and under the Indian Act from 1876 until 1955, Status Indians would lose their legal and ancestral identities (or Indian Status) for a variety of reasons, especially if they were women. In 1969, Prime Minister Trudeau proposed a “white paper” policy with the aim of achieving greater equality for Indians. To do this, he proposed to abolish the Indian Act. However, abolishing the Indian Act would mean eliminating First Nations rights, and Indigenous thought leaders like Russell Diabo have long warned about the dangers in falling for the government’s Indian Act abolishment agenda. Therefore, the Indian Act has not been abolished to date.
